Withdrawal

No Statutory Right of Withdrawal for Scheduled Accommodation in Germany

For bookings of Luxrem Apartments in Germany (Luxrem Apartments 1–3, Theodor-Körner-Straße 29, 42853 Remscheid), there is generally no statutory right of withdrawal under German consumer law where the booking concerns an accommodation service at a specific date or period.

Under § 312g(2) No. 9 BGB, the right of withdrawal does not apply to contracts for the provision of services in the field of accommodation for purposes other than residential use, where the contract provides for a specific date or period for performance.

As Luxrem Apartments offers stays for specifically booked periods as a short-term/serviced apartment rental, the booking is excluded from the statutory right of withdrawal.

Switzerland

For bookings of Luxrem Apartments in Switzerland (Luxrem Apartments 4–6, Brüggstr. 119, 2503 Biel/Bienne), Swiss law does not in principle provide a general statutory right of withdrawal for distance sales equivalent to that under EU/German consumer law.

Cancellations, rebookings and refunds are therefore governed by the cancellation terms agreed at the time of booking, the General Booking Terms and Conditions, and mandatory statutory provisions.

Cancellation Instead of Withdrawal

Independently of any statutory right of withdrawal, guests may cancel a booking in accordance with the agreed cancellation terms or request a rebooking. The applicable cancellation conditions are stated in the booking process, in the booking confirmation or in the General Booking Terms and Conditions.
